1. Acceptance of Terms
Welcome to the website of Taproots at Camp Walden (“we,” “us,” or “our”), a 501(c)(3) nonprofit organization based in Michigan. These Terms of Use (“Terms”) govern your access to and use of our website at taprootswalden.org (the “Site”).
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Site.
2. Intellectual Property Rights
The Site and all of its content—including text, graphics, logos, images, photographs, video, and the “Taproots at Camp Walden” name and marks—are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Site for your own personal, non-commercial purposes. All rights not expressly granted here are reserved by us.
You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Site without our prior written permission, except for personal, non-commercial use (such as printing a page for your own reference).
3. Acceptable Use Policy
When using our Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law;

Donations made through the Site are processed by a third-party donation platform. Donations are voluntary and, unless otherwise stated, non-refundable.

We strive to provide helpful and accurate information on our Site, but we cannot guarantee everything is perfect or always available.
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS, OR THAT ANY CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TAPROOTS AT CAMP WALDEN AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND VOLUNTEERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, REGARDLESS OF THE THEORY OF LIABILITY.
TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE IS LIMITED TO THE GREATER OF FIFTY DOLLARS ($50.00) OR THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
9. Indemnification
You agree to indemnify, defend, and hold harmless Taproots at Camp Walden and its directors, officers, employees, and volunteers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
10. Dispute Resolution
Informal Resolution First
Before initiating any formal dispute proceeding, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days.
Binding Arbitration
If we cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its applicable rules then in effect. Arbitration will take place in Suffolk County, Massachusetts. The arbitrator’s decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver
You and Taproots at Camp Walden agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.
Exceptions
Notwithstanding the above, either party may (a) bring an individual action in small claims court if the claim qualifies, or (b) seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.
11. Governing Law and Forum
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles.
To the extent a matter is not subject to arbitration as provided above, you agree that the exclusive jurisdiction and venue for any legal action arising out of or relating to these Terms will be the state and federal courts located in Suffolk County, Massachusetts, and you consent to the personal jurisdiction of those courts.
12. Changes to These Terms
We may update these Terms from time to time. If we make changes, we will revise the “Last Updated” date at the top of this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
13. Termination
We may suspend or terminate your access to the Site at any time, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, the provisions of these Terms that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law) will continue to apply.
14. General Provisions
- Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Taproots at Camp Walden regarding your use of the Site.
- Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- No Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment. We may assign our rights and obligations under these Terms without restriction. You may not assign your rights or obligations without our prior written consent.
- Headings. Section headings are for convenience only and have no legal effect.
